There are three types of defects that may cause injury, giving rise to what is known as “product liability”:

• Defects in design
• Defects in manufacturing
• Defects in marketing, such as errors in labeling, instructions or safety warnings

There is both federal and provincial legislation relating to product liability. However, consumers can also make a claim in court based on negligence, breach of contractual warranty or breach of statutory warranty.
