Silica Trust Claims

What Is Silicosis?

Silicosis is a progressive and often disabling lung disease caused by inhaling respirable crystalline silica dust. The condition causes scarring in the lungs, which can reduce breathing capacity, cause chronic respiratory issues, and, in severe cases, lead to death. Silicosis is a recognized occupational disease.

Silica Exposure and Your Health

Inhaling fine particles of crystalline silica can cause serious and sometimes fatal health conditions. Workers exposed in industries like mining, construction, foundries, and sandblasting are at high risk of developing:

  • Silicosis (simple or complicated)
    • Tuberculosis, silicoproteinosis, coalescence of silicotic opacities (PMF or Honeycombing) rheumatoid arthritis, scleroderma, lupus, glomerulonephritis, mixed connective tissue disorder.
  • Lung cancer
  • Autoimmune disorders linked to silica
  • Chronic respiratory failure

These conditions may take years or even decades to develop. Fortunately, several compensation trusts have been set up to provide financial support to those suffering from these illnesses, even Canadians who worked outside the United States.

Who Is at Risk?

Exposure to silica dust occurs in many industrial, construction, and mining environments. High-risk occupations include:

  • Miners (gold, coal, uranium, etc.)
  • Ironworkers and welders
  • Sandblasters
  • Foundry workers
  • Tunnel and road construction workers
  • Demolition crews
  • Petrochemical Workers

In many cases, exposure happens because proper respiratory protection was not provided, or employers failed to implement adequate ventilation and dust control systems.

Legal Options for Silica Exposure in Canada

If you developed silicosis or a related lung condition from workplace silica exposure, you may have multiple options for compensation:

  1. Workers' Compensation Boards
Depending on where you worked, a claim may be available through your provincial compensation board.
  2. Silicosis Trusts (U.S.-Based Claims)
Several U.S. companies that produced or used silica products have filed for bankruptcy and created settlement trusts. If you worked with silica-containing products from one of these companies, you may be eligible for a claim, even if you worked in Canada. We can assess your claim to see if you will receive greater compensation from the trusts compared to the WCB.
