Yaz/Yasmin Class Action Settlement
There is now a proposed Canada-wide settlement for individuals who suffered blood clots or gallbladder issues after taking the birth control pills Yaz or Yasmin. These pills were widely prescribed across Canada beginning in the early 2000s, and legal proceedings have been ongoing for more than a decade.
The settlement applies to all persons resident in Canada who were prescribed and ingested Yasmin and/or YAZ between December 10, 2004 (for Yasmin) or January 6, 2009 (for YAZ) and, in the case of residents of Ontario and Quebec, November 30, 2011; and in the case of all other Canadian residents, October 4, 2016.

While we are participating in the claims process and assisting clients in obtaining compensation, we are disappointed with the low settlement amounts. In our view, the compensation offered does not reflect the seriousness of the injuries many people suffered, particularly in cases involving stroke, blood clots, death or the removal of the gallbladder. Unfortunately, this is a common outcome in Canadian pharmaceutical class actions, where settlements tend to be far lower than in the U.S. We believe this settlement is limited and inadequate, but for many people, it may be the only available route to any compensation.

Nationwide Eligibility for Yaz/Yasmin Settlement
With the recent proposed Canada-wide settlement, individuals in all provinces and territories may now qualify for compensation—not just Ontario or Quebec. This includes people who were prescribed Yasmin starting December 10, 2004, or YAZ starting January 6, 2009, and who experienced blood clots, stroke, pulmonary embolism, heart attack, or gallbladder disease.
You do not need to have filed a lawsuit or be listed in any database to make a claim. As long as you haven’t opted out of the class action, you are automatically included and can submit a claim if eligible.

Claim Against Bayer
Yaz and Yasmin have been linked to serious health risks, including deep vein thrombosis, pulmonary embolism, stroke, heart attack, and gallbladder disease. These risks are linked to the drugs’ unique hormone combination, which can lead to dehydration, electrolyte imbalances (such as hyperkalemia and hyponatremia), and resulting cardiac and vascular complications.
While lawsuits in the United States have resulted in billions of dollars in settlements, particularly for blood clot and embolism cases, settlements for gallbladder removal were much lower (typically $2,000 to $3,000 USD). The U.S. litigation also led to updated product warnings and advertising changes by Bayer.
In Canada, compensation is now being made available for qualifying cases through a proposed national class action settlement. The focus is on individuals who suffered serious side effects before stronger warnings were added to the drug packaging.

Yaz and Yasmin have been marketed as low-estrogen birth control pills, implying a reduced risk of blood clots. However, growing research has shown that the progestin (drospirenone) in these pills may also increase the risk of thrombotic events such as deep vein thrombosis, pulmonary embolism, stroke, and heart attack. These risks have affected thousands of women across Canada.
Class actions have been certified in Ontario, Quebec, and across the rest of Canada. The legal process has been slow, but it has now reached a point where compensation is expected to be available through a national settlement.
